Bezpečie Vašich osobných údajov je pre nás prioritou. Osobným údajom a ich ochrane venujeme preto náležitú pozornosť. V týchto Zásadách spracovania osobných údajov („Zásady“) by sme Vás chceli informovať o tom, aké osobné údaje o Vás zhromažďujeme a akým spôsobom ich ďalej používame.
1. Osobné údaje a ich spracovanie
1.1. Kategórie osobných údajov
Zhromažďujeme rôzne údaje v závislosti od toho, ktoré z našich služieb využívate.
Pokiaľ u nás nakupujete, zhromažďujeme: Meno a kontaktné údaje, meno a priezvisko, e-mailovú adresu, poštovú adresu, fakturačnú adresu, telefónne číslo, bankové spojenie, demografické údaje, údaj o pohlaví, dátum narodenia, krajinu a uprednostňovaný jazyk, údaje vzniknuté na základe trvania zmluvy – nakúpené produkty, zákaznícky segment, objem poskytnutých služieb
Pokiaľ ste členom B2B konta, zhromažďujeme: Meno a kontaktné údaje. Meno a priezvisko, e-mailovú adresu, poštovú adresu, fakturačnú adresu, telefónne číslo, bankové spojenie, demografické údaje, údaj o pohlaví, krajine a uprednostňovaný jazyk, dátum narodenia, prihlasovacie údaje, avšak my nemáme prístup ku skutočnému heslu.
Pokiaľ od nás odoberáte marketingové správy, zhromažďujeme: Meno a kontaktné údaje – e-mailová adresa a krstné meno, telefónne číslo, ak ste členom B2B konta aj demografické údaje – krajinu a údaj o pohlaví.
Ďalej spracovávame tieto osobné údaje: Údaje z komunikácie medzi CITTRON a zákazníkom, logy obsahujú adresu IP, údaje prehliadača (rozlíšenie, verzia, operačný systém atď.), jazyk a záznamy o správaní sa na internetových stránkach spravovaných spoločnosťou CITTRON.
1.2. Účely spracovania osobných údajov:
Poskytovanie služieb a ich zlepšovanie. Aby sme mohli poskytovať ponúkané služby a zlepšovať ich k Vašej spokojnosti, spracovávame Vaše osobné údaje.
Konkrétne sem patria: Spracovanie objednávky tovaru alebo služieb, objednaných či už prostredníctvom našej webovej stránky, mobilnej aplikácie, alebo zákazníckej linky. Zákonným dôvodom je tu nevyhnutnosť pre splnenie spotrebiteľskej zmluvy, prípadne zmluvy o B2B konte a pri vybraných údajoch na splnenie právnych povinností (napr. účtovné doklady, validácia VAT).
Upozornenie na dostupnosť tovaru. V prípade, že požiadate o stráženie dostupnosti tovaru, spracujeme Vaše osobné údaje na základe Vášho súhlasu.
Zákaznícka podpora. Na zaistenie zákazníckeho servisu a na odstránenie prípadných problémov pri plnení spotrebiteľskej zmluvy alebo zmluvy o B2B konte spracovávame Vaše osobné údaje na základe nevyhnutného splnenia týchto zmlúv.
Komunikácia. Zhromaždené údaje využívame s cieľom komunikácie s Vami a jej individuálneho prispôsobovania. Môžeme Vás napríklad kontaktovať telefonicky, e-mailom, v aplikácii alebo inou formou, aby sme Vám pripomenuli, že máte tovar v online košíku, pomohli Vám s dokončením Vašej objednávky, oznámili Vám aktuálny stav Vašej žiadosti, objednávky alebo reklamácie alebo k nej od Vás získali ďalšie informácie alebo Vás upozornili, že musíte vykonať akciu nutnú na zachovanie aktívneho stavu Vášho účtu. Ak ste členom B2B konta, spracovávame údaje na tento účel z dôvodu plnenia zmluvy o B2B konte. Ak u nás nakupujete ako nečlen, spracovávame tieto údaje z dôvodu oprávneného záujmu, ktorý vnímame ako náš oprávnený záujem, ako je uvedené vyššie.
Zlepšovanie služieb. Údaje používame na stále zlepšovanie našich služieb a systémov vrátane pridávania nových funkcií a zároveň s cieľom robiť informované rozhodnutia za použitia súhrnných analýz a to všetko na základe nášho oprávneného záujmu odvíjajúceho sa od slobody podnikania a spočívajúceho v nevyhnutnosti zlepšovania poskytovaných služieb kvôli úspechu v obchodnej súťaži. Aby sme zaistili dostatočnú ochranu Vašim právam a záujmom, používame na účely zlepšovania osobné údaje v anonymizovanej podobe.
Ochrana, bezpečnosť a riešenie sporov. Údaje môžeme spracovávať aj z oprávneného záujmu, ktorý spočíva v zaistení ochrany a bezpečnosti našich systémov a našich zákazníkov, na zisťovanie a prevenciu podvodov, riešenie sporov a presadzovanie našich dohôd na základe oprávneného záujmu.
Obchodné oznámenie. Zasielame Vám obchodné oznámenie týkajúce sa obdobných produktov, ako ste si kúpili. Tieto obchodné oznámenia môžete vždy odmietnuť prostredníctvom odkazu pre odhlásenie, ktorý nájdete v každom e-maile. V prípade, že odoberanie obchodných oznámení odhlásite, nebudeme naďalej Vaše elektronické kontakty na tieto účely využívať. Začneme ich opäť využívať, pokiaľ ich zaregistrujete alebo si ich výslovne vyžiadate.
Marketingové ponuky. Marketingové ponuky, ktoré sa Vám zobrazujú, môžu byť vybrané na základe ďalších informácií, ktoré sme o Vás v priebehu času získali podľa kontaktných údajov, demografických údajov, obľúbených položiek a údajov o používaní z našich produktov a webov (cookies, IP adresa, údaje poskytnuté vaším prehliadačom, údaje o odklikoch, zobrazených obchodných oznámeniach, navštívených produktoch atď.). Nevykonávame plne automatizované spracovanie, ktoré by malo pre Vás právne účinky.
Ak ste členom B2B konta, spracovávame údaje na tento účel z dôvodu plnenia zmluvy o B2B konte. Ak u nás nakupujete ako nečlen, spracovávame tieto údaje z dôvodu oprávneného záujmu, ktorý vzniká pri každom bežnom marketingu.
Pokiaľ nie ste naším zákazníkom, spracovávame údaje na základe Vášho súhlasu. Máte právo kedykoľvek bezplatne vzniesť námietku proti týmto spracovávaniam. Kontaktné údaje sú uvedené na konci tohto dokumentu.
Spracovávanie cookies z internetových stránok prevádzkovaných spoločnosťou CITTRON. V prípade, že máte vo svojom webovom prehliadači povolené cookies, spracovávame záznamy správania z cookies umiestnených na internetových stránkach prevádzkovaných spoločnosťou CITTRON, a to na účely zaistenia lepšej prevádzky internetových stránok neogenesis.eu a na účely internetovej reklamy spoločnosti CITTRON. Viac informácií nájdete v samostatnej kapitole tohto dokumentu.
1.3. Odovzdanie osobných údajov tretím stranám
Vaše osobné údaje budú odovzdané tretím osobám či inak sprostredkované iba vtedy, ak je to nevyhnutné v rámci plnenia spotrebiteľskej zmluvy, zmluvy o B2B konte, na základe oprávneného záujmu alebo pokiaľ ste s tým vopred vyslovili súhlas, a to:
a) sesterským spoločnostiam a spracovateľom na základe plnenia spotrebiteľskej zmluvy alebo zmluvy o B2B konte pre výkon interných procesov a postupov
b) spoločnostiam vydávajúcim kreditné karty, poskytovateľom platobných služieb s cieľom spracovania platieb a bankám na základe Vašej objednávky, plnenia spotrebiteľskej zmluvy
c) prepravcom s cieľom dodania Vami objednaných produktov alebo služieb a riešenia reklamácií vrátane odstúpenia od zmluvy
d) našim partnerom, vo vernostných schémach, do ktorých sa zapojíte
e) ďalším poskytovateľom služieb, tretím stranám zapojeným do spracovania dát
f) tretím stranám, napr. právnym alebo finančným zástupcom, súdom za účelom spracovania daňových dokladov, vymáhanie pohľadávok alebo ďalších dôvodov vyplývajúcich z plnenia našich zákonných povinností
g) verejným orgánom (napr. polícia, prokuratúra atď.)
h) tretím stranám vykonávajúcim prieskumy medzi zákazníkmi
Pokiaľ tretie osoby použijú údaje v rámci ich oprávneného záujmu, nenesie za tieto spracovania správca zodpovednosť. Tieto spracovania sa riadia zásadami spracovania osobných údajov príslušných spoločností a osôb.
2. Zákaznícke konto a nákup bez registrácie
a) V rámci uzavretia zmluvy o zákazníckom konte Vám založíme zákaznícke konto, ktoré je zabezpečené heslom. V rámci zákazníckeho konta získavate priamy prístup k svojim údajom vrátane ich editácie a môžete takto nahliadať do svojich údajov o dokončených aj nedokončených objednávkach a upravovať zasielanie noviniek. Prostredníctvom zákazníckeho konta môžete taktiež upravovať svoje osobné údaje a zasielanie propagačných letákov.
b) Súčasťou zákazníckeho konta je aj B2B konto. Viac informácií nájdete v príslušných obchodných podmienkach.
c) Pokiaľ si neprajete založiť pre uskutočnenie nákupu zákaznícke konto, môžete v našom e-shope takisto nakupovať aj bez registrácie.
d) Máte právo ukončiť zmluvu o zákazníckom alebo B2B konte v súlade s príslušnými obchodnými podmienkami.
3. Zabezpečenie osobných údajov a obdobie uchovávania
3.1. Zabezpečenie osobných údajov
a) Vaše osobné údaje sa k nám prenášajú v zakódovanej podobe. Používame kódovací systém SSL (secure socket layer). Zabezpečujeme naše webové stránky a ostatné systémy pomocou technických a organizačných opatrení proti strate a zničeniu Vašich údajov, proti prístupu neoprávnených osôb k Vašim údajom, ich pozmeňovaniu či rozširovaniu.
b) Od našich spracovateľov vyžadujeme preukázanie súladu ich systémov s nariadením GDPR.
c) Prístup do Vášho zákazníckeho konta je možný iba po zadaní Vášho osobného hesla. V tejto súvislosti by sme Vás chceli upozorniť, že je nevyhnutné, aby ste Vaše prístupové údaje neoznamovali tretím osobám a po ukončení Vašej činnosti v zákazníckom konte vždy zavreli okno svojho webového prehliadača, najmä vtedy, ak používate počítač spolu s inými používateľmi. CITTRON nepreberá zodpovednosť za zneužitie použitých hesiel.
3.2. Obdobie spracovania
Osobné údaje spracovávame a uchovávame
a) v čase nevyhnutnom na zaistenie všetkých práv a povinností vyplývajúcich z spotrebiteľskej zmluvy, t. j. počas objednávky a záručnej lehoty
b) počas trvania zmluvy o B2B konte
c) 1 rok od skončenia záručnej lehoty z dôvodu riešenia potenciálnych sporov
d) v čase, počas ktorého je CITTRON povinný ako správca uchovávať podľa všeobecne záväzných právnych predpisov ako sú účtovné doklady alebo napr. faktúry vystavené spoločnosťou CITTRON, ktoré sú v súlade so zákonom archivované 10 rokov od ich vystavenia.
e) Súhlas pre upozornenie na dostupnosť tovaru zostáva v platnosti do odoslania informácie o dostupnosti, najdlhšie však počas 1 roka alebo do jeho odvolania.
f) Súhlas s marketingovými ponukami je platný 4 roky alebo do odvolania
g) Recenzie max. 6 rokov.
h) Komunikáciu max. 2 roky
i) Akcie max. 1 rok
V ostatných prípadoch vyplýva obdobie spracovania z účelu spracovania alebo je dané právnymi predpismi v oblasti ochrany osobných údajov.
4. Práva subjektov údajov
a) Pokiaľ spracovávame Vaše osobné údaje, môžete kedykoľvek požadovať bezplatnú informáciu o spracovávaní svojich osobných údajov.
b) V prípade, že sa domnievate, že spracovanie osobných údajov robíme v rozpore s ochranou Vašich osobných údajov a zákonnými podmienkami ochrany osobných údajov, môžete požiadať o vysvetlenie, požadovať, aby sme odstránili takto vzniknutý stav, najmä môžete požadovať urobenie opravy, doplnenie, likvidáciu osobných údajov alebo blokáciu osobných údajov.
c) Pre uplatnenie svojich práv kontaktujte poverenca pre ochranu osobných údajov na e-mailovej adrese dpo@neogenesis.eu. Obrátiť sa môžete aj na Úrad na ochranu osobných údajov.
d) Svoj súhlas so spracovaním osobných údajov môžete kedykoľvek odvolať. Pokiaľ odvoláte súhlas so spracovaním osobných údajov, budú Vaše osobné údaje vymazané alebo anonymizované; to sa však netýka tých osobných údajov, ktoré CITTRON potrebuje na splnenie zákonných povinností (napr. vybavenie už podanej objednávky) či na ochranu svojich oprávnených záujmov. K likvidácii osobných údajov dôjde takisto v prípade, že osobné údaje nebudú potrebné pre stanovený účel alebo ak bude uloženie Vašich údajov neprípustné z iných zákonom stanovených dôvodov.
5. Webové stránky
5.1. Súbory cookies
Naše stránky používajú tzv. cookies, aby naša ponuka bola pre Vás relevantná, zaujímavá a používateľsky príjemná. Cookies sú malé textové súbory, ktoré sú uložené vo vašom počítači, smartfóne či inom zariadení a ktoré sa používajú vo vašom prehliadači. Viac informácií o súboroch cookies môžete nájsť tu. Súbory cookies využívame napr. na:
a) správnu funkčnosť košíka tak, aby ste čo najjednoduchšie dokončili svoju objednávku
b) zapamätanie Vašich prihlasovacích údajov, takže ich nemusíte opakovane zadávať
c) čo najlepšie prispôsobenie našich stránok Vašim požiadavkám vďaka sledovaniu návštevnosti, Vášho pohybu po stránkach a využitých funkciách
d) zistenie informácií o prezeraní reklám, aby sme Vám nezobrazovali reklamu na tovar, o ktorý nemáte záujem
Niektoré súbory cookies môžu zhromažďovať informácie, ktoré sú následne využité tretími stranami a ktoré napr. priamo podporujú naše reklamné aktivity (tzv. „cookie tretích strán“). Napríklad informácie o kupovaných produktoch na našich stránkach môžu byť zobrazené reklamnou agentúrou v rámci zobrazenia a prispôsobenia internetových reklamných bannerov na Vami zobrazovaných webových stránkach. Podľa týchto údajov Vás však nemožno identifikovať.
5.2. Využitie súborov cookies
Súbory cookies používané na našich stránkach možno rozdeliť na dva základné typy:
a) Krátkodobé, tzv. „session cookies“, sú zmazané ihneď, len čo ukončíte návštevu našich stránok.
b) Dlhodobé, tzv. „persistent cookies“, zostávajú uložené vo vašom zariadení omnoho dlhšie alebo kým ich ručne neodstránite (čas ponechania súborov cookies vo vašom zariadení závisí od nastavenia samotnej cookie a nastavenia Vášho prehliadača).
Cookies možno tiež rozdeliť podľa ich funkčnosti na:

The security of your personal data is our priority. We therefore pay due attention to personal data and its protection. In the Personal Data Processing Policy (the “Policy”), we would like to inform you about how we collect personal data about you and how we then use it.
1. Personal data and its processing
1.1. Personal data categories
We collect various types of data, depending on which of our services you are using.
If you shop with us, we collect your: Name and contact details, first name and surname, email address, delivery address, billing address, phone number, bank details, demographic data, data about gender, date of birth, country and preferred language, data as a result of the duration of the agreement – products bought, customer segment, volume of services provided;
If you are a member of the B2B account, we collect: Name and contact details, first name and surname, email address, delivery address, billing address, phone number, bank details, demographic data, data about gender, country and preferred language, date of birth, login details but we have no access to the actual password.
If you are on our marketing mailing list, we collect: Name and contact details – email address and first name, telephone number, if you are a member of a B2B account also demographic details – country, gender.
We also process the following personal data: Data from communication between CITTRON and the customer, behavioral records for websites operated by CITTRON.
1.2. Purpose of processing personal data:
Provision of services and their improvement. In order to provide the services offered and improve them to your satisfaction, we process your personal data. This means specifically: Processing orders for products or services, ordered via our website, mobile application or customer hotline. The legal reason is the need to fulfil the purchase agreement or the B2B account Agreement and, for selected data, to meet legal obligations (e.g. accounting documents).
Notification of the availability of products. If you ask to monitor the availability of products, we will process your personal data based on your consent.
Customer support. To provide customer service and prevent any problems when fulfilling a purchase agreement or B2B account Agreement, we will process your personal data on the basis of the necessary fulfilment of these agreements.
Communication. We use the data that is collected to communicate with you and to adapt it for each individual. For example, we may contact you by phone, email or through the app or some other format to remind you that you have products in your online basket, to help you complete your order, give you the current status of your request, order or return or get more information from you about it, or notify you that you need to take action to keep your account active. If you are a member of the B2B account, we will process data for this purpose to fulfil the B2B account Agreement. If you shop with us as a non-member, we process this data for the purpose of fulfilling the purchase agreement or implementing the measures adopted before the conclusion of the agreement.
Improving services. We use data to continuously improve our services and systems, including adding new features and also to make informed decisions through the use of pooled analysis and business intelligence, all on the basis of our legitimate interest derived from the freedom of business and on the basis of the need to improve the services provided for competitive success. To ensure the adequate protection of your rights and interests, we use personal data in an anonymized form for the purpose of making improvements to our services.
Protection, security and dispute resolution. We may also process data out of legitimate interest, to ensure the protection and security of our systems and customers, detect and prevent fraud, resolve disputes and enforce our agreements on the basis of legitimate interest.
Commercial communication. We send you commercial communications about similar products to those you have purchased. You can always decline commercial communications via the unsubscribe link found in every email. If you unsubscribe from commercial communications, we will stop using your electronic contact information for this purpose. We will start using it again if you register or request it specifically.
Marketing offers. The marketing offers you see may be chosen on the basis of other information we have gathered about you over time according to contact details, demographic data, favorites and data about using our products and websites (cookies, IP address, data provided by your browser, click data, commercial communications displayed, products visited). We do not have fully automated processing which would have a legal impact on you.
If you are a member of the B2B account, we will process data for this purpose to fulfil the B2B account Agreement. If you shop with us as a non-member, we process this data because of legitimate interest, which belongs in the sphere of legitimate conventional marketing.
If you are not our customer, we will process your data on the basis of your consent.
You have the right to raise an objection to the processing at any time free of charge. Contact details are provided at the end of this document.
Processing of cookies from websites operated by CITTRON. If you have permitted cookies on your web browser, we will process records of behavior from the cookies located on the websites operated by CITTRON to ensure better operation of the CITTRON website and for internet advertising by CITTRON. More information can be found in a separate chapter of this document. You consent with cookies through browser settings.
1.3. Transfer of personal data to third parties
Your personal information will be passed on to third parties or otherwise arranged only if it is necessary to fulfil a purchase agreement or B2B account Agreement, is based on legitimate interest, because of the need to outsource, or if you have given your consent to this in advance, as follows:
a) to affiliated companies and processors based on fulfilment of the purchase agreement or the B2B account Agreement to perform internal processes and procedures;
b) to companies issuing credit cards, to providers of payment services to process payments and to banks on the basis of your order, to fulfil a purchase agreement;
c) to carriers to deliver your order or services and to resolve complaints, including withdrawal from an agreement;
d) to our partners, in loyalty schemes that you join;
e) to other service providers and third parties involved in data processing;
f) to third parties, e.g. legal or financial representatives or courts, for the purpose of the processing of tax documents, recovery of debts or for other reasons ensuing from the fulfilment of our legal obligations;
g) public authorities (e.g. the police);
h) third parties carrying out surveys among customers.
If a third party uses data in connection with their legitimate interests, the controller is not liable for this processing. This processing is governed by the personal data processing policy of the relevant companies and individuals.
2. The customer account and purchasing without registering
a) As part of your entering into a customer account Agreement, we will open a customer account for you which is password-protected. As part of the customer account, you will get direct access to your data, including editing, and you can view your data about both completed and incomplete orders and edit your newsletter preferences. You can also manage your personal data and newsletter preferences via the customer account.
b) The B2B account, where we offer you a range of benefits, is included in the customer account. For more information, refer to the relevant terms and conditions.
c) If you do not wish to set up a customer account to make a purchase, you can also shop without a registering in our webstore.
d) You have the right to terminate the customer or B2B account Agreement in accordance with the relevant terms and conditions.
3. Personal data security and retention period
3.1. Personal data security
a) Your personal data is transmitted to us in encrypted form. We use the SSL (secure socket layer) technology. We secure our websites and other systems using technical and organizational measures against the loss and destruction of your data, unauthorized access to your data or its modification or dissemination.
b) We require our processors to prove compliance of their systems with the GDPR.
c) Access to your customer account is only possible after entering your personal password. In this context, we would like to draw your attention to the fact that you must not share your access data with third parties and after finishing your activity in your customer account, always close the window of your web browser, especially if you are using a public computer. CITTRON is not liable for the misuse of used passwords.
3.2. Duration of processing
We process and store personal data:
a) for the period necessary to ensure all rights and obligations arising from the purchase agreement, i.e. for the duration of the order and warranty period
b) for the duration of a B2B account Agreement
c) one year after the end of the warranty period to resolve potential disputes
d) for the period in which CITTRON is obliged as the controller to store it in accordance with generally binding legislation, such as accounting documents or e.g. invoices issued by CITTRON, are archived according to law for 10 years from being issued.

b) The B2B account, where we offer you a range of benefits, is included in the customer account. For more information, refer to the relevant terms and conditions.
